TV – Copyright infringement claim
We defended a copyright infringement claim against a TV production company insured that had used clips from a popular TV series during a documentary about one of its stars. The claimant was the owner of the rights to the TV series and complained that no licences had been purchased for use of the clips. The insured had sought legal advice ahead of broadcast that confirmed fair dealing defences would be available under the Copyright Designs and Patents Act 1988.
Proceedings were commenced in the US despite our insured being UK based and broadcast having been on the BBC. The claimant alleged that, because they were based in the US and people might have been able to view the documentary in the US, the US courts had jurisdiction to hear the matter. The US courts disagreed, and we were successful in our motion to dismiss at very early stages.
